Terms of Service
These Terms of Service ("Terms") govern your access to and use of the StayRadar software, website, and related services (the "Service") provided by Legendaire Hospitalite LLC, a Florida limited liability company doing business as StayRadar ("StayRadar," "we," "us"). By purchasing, downloading, installing, or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and represent a business or organization to use the Service. By accepting these Terms, you represent that you have authority to bind the business or entity on whose behalf you act.
2. The Service
StayRadar is a Windows desktop application that helps hotel sales teams send personalized cold-outreach email. The Service generates email drafts using artificial intelligence, sends them through your own connected email account, tracks replies, and schedules follow-ups. The Service is provided on a subscription basis.
3. Account and license
Your license key
Upon purchase, we issue you a unique license key tied to your subscription. The license is a personal, non-transferable, non-sublicensable right to use the Service while your subscription is active.
Keeping your license secret
You are responsible for keeping your license key confidential. Activity performed using your license key is your responsibility. If you believe your key has been compromised, contact us immediately at [email protected] and we will issue a replacement.
Quotas
Each subscription plan has a maximum number of personalized emails per day:
- Starter: up to 20 emails per day
- Pro: up to 40 emails per day
- Unlimited: up to 60 emails per day
Once a day's quota is reached, the Service will stop processing AI-generated emails until the next calendar day (UTC).
4. Payment and subscriptions
Billing
Subscriptions are billed monthly in advance via our payment processor, Stripe. Prices are listed on stayradar.app and may change with at least 30 days' notice for renewals.
Trial period
If a free trial is offered when you sign up, you will not be charged during the trial. Your card will be charged automatically at the end of the trial unless you cancel beforehand.
Auto-renewal
Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel any time through your Stripe customer portal or by emailing us.
Refunds
Subscriptions are non-refundable for partial months. If you cancel, your access continues through the end of the current billing period. We may offer refunds at our discretion for exceptional cases (e.g., extended Service outage caused by us).
5. Acceptable use
You agree NOT to use the Service to:
- Send unsolicited commercial email in violation of the CAN-SPAM Act, GDPR, CASL, or any other applicable anti-spam law
- Send messages that are deceptive, fraudulent, harassing, threatening, hateful, obscene, or illegal
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Send malware, phishing links, or attempt to obtain login credentials
- Violate the terms of service of Google, Gmail, or any other third-party platform integrated with the Service
- Reverse-engineer, decompile, or attempt to derive the source code of the Service except as expressly permitted by law
- Share your license key with anyone outside your business, sublicense the Service, or use a single license across multiple businesses
- Use the Service to compete with StayRadar or build a similar product
You are solely responsible for the content of emails you send through the Service, including the accuracy of claims, inclusion of legally-required unsubscribe instructions, and inclusion of a valid physical mailing address.
6. Customer content
You retain ownership of all prospect data, hotel information, email content, and other materials you provide to or create through the Service ("Customer Content"). You grant us a limited license to process Customer Content solely to provide the Service to you.
You represent that you have all rights necessary to upload, send, and process the Customer Content, and that doing so does not violate any third-party rights or applicable law.
7. AI-generated content
The Service uses large-language-model AI to generate email drafts. AI-generated content may contain inaccuracies. You are responsible for reviewing every email before sending, and for the truthfulness of any claims, rates, availability, or commitments made in your outreach. StayRadar makes no warranty that AI output will be accurate, appropriate, or free of error.
8. Third-party services
The Service integrates with third-party providers including Stripe (payments), Anthropic (AI), Resend (email), Google (Gmail), and Cloudflare (hosting). Your use of those services is subject to their respective terms. We are not responsible for the acts or omissions of third-party providers.
9. Suspension and termination
We may suspend or terminate your license at any time if you breach these Terms, abuse the Service, fail to pay, or use the Service in a way that risks harm to StayRadar, our infrastructure providers, or other users. We will give reasonable notice where possible.
You may stop using the Service at any time by cancelling your subscription. Cancellation does not entitle you to a refund of the current billing period.
10. Disclaimer of warranties
The Service is provided "as is" and "as available."
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or that defects will be corrected. We make no warranty about results obtained through the Service or about the accuracy or reliability of any AI-generated content.
11. Limitation of liability
To the maximum extent permitted by law:
- In no event will StayRadar be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or substitute service costs, even if advised of the possibility.
- StayRadar's total cumulative liability arising out of or related to these Terms or the Service will not exceed the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater.
12. Indemnification
You agree to defend, indemnify, and hold StayRadar harmless from any claim, demand, or expense (including reasonable attorney's fees) arising out of:
- Your use of the Service in violation of these Terms or applicable law
- Emails you send through the Service that violate CAN-SPAM or any other law
- Customer Content you upload to or process through the Service
- Your violation of any third-party right, including intellectual-property or privacy rights
13. Governing law and disputes
These Terms and any dispute arising from them are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any legal action must be brought in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
14. Changes to these Terms
We may modify these Terms from time to time. We will post the updated Terms on stayradar.app and update the "Last updated" date above. For material changes, we'll notify active subscribers by email at least 30 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance.
15. Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and StayRadar regarding the Service.
Severability. If any provision is held unenforceable, the rest will remain in effect.
Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of our business.
